USCIS Finally Issues Policy Manual On TN Visas

Since its creation in 2003, USCIS had never publicly released its policy manual on the requirements for the TN visa classification. On June 4, 2025, USCIS finally issued its policy for the adjudication of TN visas. This guidance largely tracks and consolidates the government's guidelines on TNs found in the USCBP’s Inspector’s Field Manual, previously released USCIS/USCBP memos that generally only addressed singular adjudicative issues, and in TN visa decision trends. I will review the manual in more detail, and provide commentary on any policy deviations shortly. The final release of this manual, however, suggests to me that the TN visa classification may be ripe for more heightened scrutiny from USCIS in the near future.
