TN Visa Approval for Architect Training AI Solution

BACKGROUND:    

  • The applicant, a citizen of Canada, was offered a position where they would be preparing architectural drawings and design plans to “train” a company’s Artificial intelligence (AI) Architecture solution that would help architects create more efficient building layouts.

  • The applicant possessed a Bachelor’s degree in Environmental Design.

SOLUTION:    

  • One of the main challenges in this case was establishing to U.S. immigration that the position offered fell under the Architect TN visa occupational category even though the position did not involve the performance of traditional architectural design job tasks.

  • In order to establish eligibility, with feedback from the employer and applicant I prepared an employer support letter to explain how the job still involved performing architectural design tasks, but in order to train the company’s AI tool, and that an individual needed to be trained as an Architect in order to perform these tasks. I also provided the applicant with research confirming that AI technology can be trained by Architects to assist with architectural projects tasks.

  • Another challenge to this case was establishing that the Applicant met the educational requirements for the TN Architect category. U.S. immigration officers will often require a degree in the TN occupational category, or may be willing to accept a related degree. In order to establish eligibility based on the applicant’s degree in Environmental Design, I explained in the employer support letter that the applicant completed a substantial amount of architecture courses, and also secured a letter from the applicant’s school confirming that they completed 2 years of studies in Architecture as part of their bachelor’s degree.

FILING PROCESS:    

  • The applicant presented the application at the U.S. Pre-Flight Inspection Office in Winnipeg, which approved the application same day, and issued a 3-year I-94 record.
