6 Ways To Improve Your Chances For A TN Visa Under Trump 2.0

Despite the doom and gloom surrounding US immigration (and there is doom and gloom), qualified individuals can still obtain TN visa status under Trump 2.0. While this is an era of enhanced vetting, TN requirements have not deviated significantly (with some exceptions). 

Here are 6 ways to improve your chances for a TN visa under Trump 2.0:

1. Job Offer In A TN Category: 

  • Applicants with a job title aligning with the TN occupation, and job duties consistent with the description of the TN occupation in the OOH will have the strongest case for a TN. 

  • Otherwise, be prepared to explain how your job qualifies. 

2. Degree In TN Field: 

  • Applicants with a degree directly in the TN field will have the strongest case for a TN. 

  • Otherwise, be prepared to explain how your degree is relevant. 

  • A major Trump 2.0 change: Denials for Software Engineering TNs for applicants who do not have Software Engineering degrees.

3. Sufficient TN Support Letter: 

  • Have a TN support letter that adequately describes the job offer and the applicant's credentials. 

  • This letter should also meet the particular requirements of the reviewing agency (USCIS, CBP, Embassy).

4. Ace The Interview: 

  • Be prepared to explain who the employer is, what your job duties are and how they qualify, and what your credentials are and how they qualify. 

  • Be prepared to explain your prior immigration history, and address potential issues. 

5. Review Online Profiles: 

  • Officers are increasingly reviewing online profiles for evidence of unlawful residence or employment in the U.S. 

  • Make sure your online profile is accurate with regard to your address, dates of employment, and job title and duties. 

  • Online profiles inconsistent with your prior immigration status or your TN application can be problematic.

6. Prepare For Enhanced Vetting: 

  • Trump 2.0 has enhanced screening and vetting across agencies.

  • Any suggestion of wrongdoing (criminal, immigration-related, or fraud) may be thoroughly scrutinized.   

  • DOS is revoking visa stamps if it suspects the individual poses a security or public safety concern, e.g. DUI arrests. 

  • USCBP has been revisiting past issues even if previously resolved. Have evidence on hand to re-address. 

  • Have proof that you maintained your most recent visa status to verify no immigration violations occurred during your prior stays in the U.S.
