USCIS Reduces Validity Period of Some EADs

In response to the recent attack on National Guard service members, USCIS is reducing the validity period of Employment Authorization Documents (EAD) from 5 years to 18 months for the following categories:

  • Individuals with pending applications for adjustment of status (AOS) under INA 245

  • Individuals admitted as refugees

  • Individuals granted asylum

  • Individuals granted withholding of deportation or removal

  • Individuals with pending applications for asylum or withholding of removal

  • Individuals with pending applications for suspension of deportation, cancellation of removal, or relief under the Nicaraguan Adjustment and Central American Relief Act

Reducing the EAD validity periods for these individuals will result in more frequent vetting, which USCIS states will enable it “to deter fraud and detect aliens with potentially harmful intent so they can be processed for removal from the United States.” This new policy will apply to EAD applications pending or filed on or after Dec. 5, 2025.
