Step One: Country Ratification


  • USA - Completed

  • Mexico - Completed

  • Canada - Completed

 

Step Two: Congress Acts


  • US Congress must enact laws to implement USMCA - Completed

 

Step Three: DHS / DOS Regulates


  • U.S. Dept. of Homeland Security and Dept. of State must amend existing TN visa related regulations to become consistent with the language of the USMCA

 

Updates on the USMCA & its Impact on the TN Visa Classification


 

May 14, 2020

  • TN visas and statuses issued prior to the effective date of the USMCA will remain valid, and will be continued to be governed by the applicable NAFTA rules in effect prior to USMCA.


April 27, 2020

  • U.S. Trade Representative Robert Lighthizer says that USMCA will be effective starting July 1st. According to USCBP, the agency that handles TN visa admissions and processing at the U.S. border, USMCA regulations are pending publication.


March 30, 2020

  • The Trump administration is not on track for the USMCA to go into effect on June 1st as planned. If not, the USMCA may not go into effect until July 1st the earliest.
