TN Visa Status Approval - Data Engineer Under Engineer TN Category

BACKGROUND:    

  • The applicant, a citizen of Canada, was offered a Data Engineer position where he would be responsible for the design, development, and implementation of cloud-based software platforms used to manage large data sets.

  • The applicant possessed a PhD and Master’s degree in Computer Science, and degrees in Mathematics.

SOLUTION:    

  • In reviewing the applicant’s duties, I concluded that an argument could be made that the position offered fell under the Engineer TN visa category, which includes software engineering positions.

  • I prepared a draft employer support letter and cover letter to USCBP to show that position offered fell under the TN category for Engineers, and that the applicant’s education was sufficiently related based on his degrees in Computer Science.

FILING PROCESS:    

  • The applicant presented the application at the U.S. port-of-entry in Buffalo, NY, which approved the application same day, and issued a 3-year I-94 record.
